Imprisoned RI ex-mayor wants conviction vacated

PROVIDENCE, R.I. (AP) _ The imprisoned ex-mayor of a financially troubled Rhode Island city is asking a federal judge to vacate his corruption conviction and release him from prison after an appeals court ruled that the charge to which he pleaded guilty isn't a crime.

A lawyer for Charles Moreau filed a motion Thursday asking a federal judge to schedule a hearing on his request.

Moreau is around halfway through a two-year sentence. He pleaded guilty to corruptly accepting a gratuity by an official receiving federal funds. He accepted a furnace and home renovations from a city contractor.

In an unrelated case last year, the 1st U.S. Circuit Court of Appeals said that charge is not a crime.
       

Moreau's lawyer says the conviction is now invalid and he should be released.
