A man accused of punching a brown university student in the face leaving him in critical condition appeared in a Rhode Island court today.

Tory Lussier was in Rhode Island visiting friends he served with while in Afghanistan. His lawyer says he threw that punch in order to protect himself but prosecutors paint a very different picture.

The Marine reservist charged with throwing a punch that critically injured brown university basketball player Joe Sharkey didn't comment as he left court.

Prosecutors say 24–year–old Tory Lussier of Connecticut punched Sharkey in the face over the weekend. The blow caused Sharkey to hit his head on the pavement.

Lussier's lawyer says the incident is a clear case of self–defense.

Prosecutors say the attack was unprovoked, "he did strike the complainant in the matter outside of the area where another fight was taking place."

Lussier's linked-in account lists him as a boxing coach and trainer.

He has extensive military training serving 10 months in Afghanistan as a Lance Corporal.

A second arrest in the case was made on Friday afternoon. 22-year-old Dillon James Ingham was arrested on Friday afternoon in connection with the incident. He is charged with disorderly conduct. It is unclear what his role in the incident was. He will be arraigned on Monday.
