The Department of Business Regulations has determined that Providence nightclubs will be allowed to serve bottles of alcohol to patrons in the VIP sections.

In the case of Karma Club Inc. vs. The City of Providence Board of Licenses the department held that clubs can lawfully sell bottles of liquor to patrons in VIP sections as long as the servers continue to serve the beverage and maintain control of the bottle.

In March the Providence Board of Licenses issued a decision barring "VIP bottle service" at Karma. The decision also fined the club $2,500. As a result Karma and other clubs halted "bottle service."

In the city's decision Providence Police alleged that on an investigation they purchased a bottle of Hennessey. They noted the server poured the first drink but after that the bottle was put on ice and they were permitted to serve themselves.

The Department of Business Regulations issued a declaratory ruling stating that bottle service will be permitted as a result Karma's Attorney Peter Petrarca said the club will not be subject to the fines.

The city has ten days to appeal the decision to Superior Court.
